In October 2009 the Borough of Lindenwold entered into a contract with C. Riley Construction Company. In November of last year a complaint was filed by a carpenter by the name of Dan Christie against the construction company for circumventing prevailing wage. Today an OPRA request was sent and later received by the New Jersey Department of Labor and Workforce Division of Wage and Hour Compliance for documents pertaining to their investigation of the construction of the municipal building. From OPRA documents received, Lindenwold Mayor Frank DeLucca said that the job was not covered under prevailing wage. The mayor’s position in not correct as spelled out in investigative documents received from the state. DeLucca recently resigned as Mayor of Lindenwold, which he held since 1995. Up until the beginning of this year John Kearney was the Solicitor of Lindenwold. Did John Kearney give illegal legal advice to Lindenwold and waste more tax dollars?
Below is the Resolution, OPRA documents from the Department of Labor and Workforce and a picture of the unfinished Municipal Building. To date construction of the building has not continued.
RESOLUTION #2009:161
WHEREAS, the Borough Clerk did advertise for and receive bids on October 6, 2009 at 10:00 a.m. for pre-engineered fabricated wood roof trusses, fabricated floor trusses and fabricated interior wall panel system and plywood sheeting for the construction of a municipal building including installation, and
WHEREAS, the Certificate as to Availability of Funds is annexed hereto, and
WHEREAS, Addendum A is a list of the bidders, and
WHEREAS, the contract for pre-engineered fabricated wood roof trusses, fabricated floor trusses and fabricated interior wall panel system and plywood sheeting for the construction of a municipal building including installation be awarded to C. Riley Construction, 355 4th Avenue, Lindenwold, N.J. 08021, the lowest bidder in the amount of $174,900.00 This contract is to be awarded contingent upon the approval of the solicitor and the monies being available.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that:
1. The contract for pre-engineered fabricated wood roof trusses, fabricated floor trusses and fabricated interior wall panel system and plywood sheeting for the construction of a municipal building including installation be awarded to C. Riley Construction, 355 4th Avenue, Lindenwold, N.J. 08021, the lowest bidder in the amount of $174,900.00 This contract is to be awarded contingent upon the approval of the solicitor and the monies being available.
2. The exact title of the appropriation to be charged is Ordinance #1228.
This resolution shall take effect immediately.
